What has changed
The Migration Amendment (Training Visas—Application Requirements) Regulations 2026 (F2026L01449) were registered on 30 October 2026.
- Applying: a Subclass 407 applicant must be outside Australia when applying, unless they belong to a class of people the Minister specifies in a legislative instrument. People in a specified class may apply in or outside Australia, but not in immigration clearance.
- Grant: the applicant must be outside Australia when the visa is granted, unless they were in a specified class when they applied.
The Explanatory Statement says the change is aimed at stopping the 407 visa being used onshore to extend a stay beyond its original purpose (so-called visa hopping). It builds on the 407 sponsorship changes that started on 11 March 2026. The Statement gives occupations with genuine skills needs and family unity as examples of classes the Minister may specify.
Who it affects
- People in Australia on another visa who were planning to apply for a Training visa onshore.
- Organisations sponsoring trainees who are currently in Australia.
Offshore applicants are not affected by the location rule.
When it starts
The changes commence on 12 November 2026 and apply to Subclass 407 applications made on or after that date. Applications made before 12 November 2026 are not affected.
What you should do now
- If you are in Australia and intend to apply for a 407 visa, speak to a registered migration agent now. A complete application lodged before 12 November 2026 is assessed under the current rules.
- Watch for the Minister's legislative instrument setting out which groups can still apply onshore. We will update this article when it is published.
- Check your current visa conditions (including any No Further Stay condition) before making plans.
